1. Introduction
These Terms and Conditions apply to all bookings and use of services provided by Respire Medical Services (“we”, “us”, “our”). By booking a first‑aid training course or using our website, you agree to be bound by these terms.

If you are acting as a consumer (an individual buying for personal purposes), statutory consumer‑protection laws still apply and are not affected by these terms. If you are acting as a business (a company, organisation, or public body), you confirm that you have the authority to bind that organisation.

2. Services offered
We provide face‑to‑face first aid training courses for individuals and organisations. Content may include practical demonstrations, theory sessions, and assessments.

Course details (topics, duration, and learning outcomes) are outlined on the relevant course page or booking confirmation. We may update course content and materials from time to time.

3. Booking and payment

  • You may book a course via our website, email, or any other agreed method.
  • Course fees are shown on the date of booking and are inclusive of VAT where applicable.
  • Payment is normally required in full in advance of the course date, unless otherwise agreed in writing.
  • We reserve the right to correct any obvious pricing errors and contact you if this occurs.

4. Your obligations

  • You must be medically fit to participate in practical first‑aid activities, or notify us in advance if you have any condition that may affect your participation.
  • You undertake to follow the tutor’s instructions and behave in a safe and respectful manner.
  • We may refuse participation or ask someone to leave if their behaviour or health condition poses a risk to themselves or others.

4a. Accredited qualifications and data sharing

  • For accredited first‑aid courses, you authorise us to register your details with A&S Medical and Qualsafe Awards so that you can be formally enrolled on the qualification, take assessments, and receive your certificate.
  • You acknowledge that this may involve sharing your personal data (including name, date of birth, contact details, and assessment results) with these organisations for this purpose only.

5. Limitation of liability

  • Respire Medical Services will provide training with reasonable skill and care.
  • We are not liable for any indirect or consequential loss (for example, loss of income or business opportunity) arising from your attendance at, or failure to attend, a course.
  • Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation, as required by law.

6. Intellectual property

  • All course materials, presentations, handouts, and training resources are our intellectual property or that of our third‑party licensors.
  • You may not copy, reproduce, or distribute course materials for commercial purposes without our written permission.

7. Governing law and jurisdiction

  • These Terms and Conditions are governed by the laws of England and Wales.
  • Any disputes will be subject to the non‑exclusive jurisdiction of the courts of England and Wales.

8. Changes to these terms

  • We may update these Terms and Conditions from time to time.
  • The latest version will always be published on our website. If there are material changes, we will notify you by email where reasonably possible.

2. Cancellation and Refund Policy

1. Your statutory right to cancel (consumers)
If you are a consumer and book a first‑aid training course through our website, email, or another distance‑selling method, you have the legal right to cancel your booking within 14 days of the date the contract is concluded, without giving a reason. This is your 14‑day cooling‑off period under the Consumer Contracts Regulations 2013.

To cancel within this period, please contact us at info@respiremedical.co.uk or via the contact form on our website. Your notice should include:

  • Your full name
  • Booking reference or course date
  • A clear statement that you are cancelling the course
    If you cancel within the 14‑day period and the course has not started, we will refund all payments you have made. Refunds will normally be processed within 14 days of receiving your notice of cancellation.

2. Cancellation after the 14‑day period or for fixed‑date courses
For first‑aid training courses with a fixed start date and time, your right to cancel without charge ends once the 14‑day cooling‑off period has passed or as soon as the course begins, whichever is sooner. If you start the course at your express request during the 14‑day period, you will lose your statutory right to cancel.

If you wish to cancel or reschedule your course after the 14‑day period, the following practical‑use terms apply:

  • Cancellation more than 14 days before the course date:
    • You may cancel or reschedule your place at no extra charge.
  • Cancellation between 7 and 14 days before the course date:
    • A cancellation fee of 25% of the course fee may apply.
  • Cancellation between 3 and 7 days before the course date:
    • A cancellation fee of 50% of the course fee may apply.
  • Cancellation less than 3 days before the course date, or non‑attendance without notice:
    • A cancellation fee of 100% of the course fee may apply.

3. Rescheduling and substitutions

  • You may reschedule your course to another available date, provided you notify us at least 14 days before the original start date.
  • If you are unable to attend, you may substitute another delegate in your place, provided they meet any course‑entry requirements (e.g. age, fitness to participate). Please notify us in advance with the substitute’s name.

4. Cancellation by us

  • We reserve the right to cancel or reschedule a course if minimum numbers are not met, due to unforeseen circumstances, or for safety‑related reasons.
  • If we cancel your course, we will offer you the option to:
    • Transfer to the next available date, or
    • Receive a full refund of the course fee.

5. Special circumstances (illness, emergency)

  • If you or your organisation are unable to attend due to illness or an unexpected emergency, please contact us as soon as possible. We will consider your situation on a case‑by‑case basis and may offer a reschedule or partial refund at our discretion, subject to our standard notice‑period rules.

6. Business bookings (organisations)
For bookings made by organisations (e.g. employers, schools, charities), the above cancellation rules apply to each course booking. Organisations may also be liable for any agreed fixed‑date‑booking or venue‑hire costs if they cancel within the penalty bands, as outlined in your booking confirmation or separate agreement.

4. Accredited first‑aid courses and data sharing
For accredited first‑aid training courses, we are required to share certain learner information with A&S Medical and Qualsafe Awards so that learners can be registered, assessed, and awarded qualifications in accordance with the awarding body’s requirements.

The information we may share includes:

  • Name, date of birth, and contact details
  • Course details (qualification title, course date, centre name)
  • Assessment and attendance records
    A&S Medical acts as our partner/processing partner in the Independent Trainer Partnership Programme, and Qualsafe Awards is the awarding body for the qualification. We only share information that is necessary for enrolment, assessment, and certification, and we do not share data for any unrelated purposes.
    Where applicable, A&S Medical and Qualsafe will process your data in accordance with their own privacy notices and UK data‑protection law. You can view their privacy information at their respective websites if you wish.

5. Legal basis and consent

  • Where you are a consumer, we rely on contractual necessity (to deliver your course) and, where applicable, your consent (for marketing).
  • Where you are a business client, we may also rely on legitimate interests (e.g. managing the client relationship), balanced against your rights.

  • We may share data with third‑party service providers only where necessary (e.g. payment processors, venues, or assessment bodies), and only under appropriate data‑protection agreements.
